1. Introduction

Welcome to Aerials By Ashutosh ("we", "our", "us"). By engaging our drone photography and cinematography services, you ("the Client") agree to be bound by these Terms and Conditions. Please read them carefully before confirming any booking.

2. Services

Aerials By Ashutosh provides professional drone aerial photography, videography, survey, and related post-production services. The exact scope of services for each project will be confirmed in a written brief or booking confirmation.

We reserve the right to decline any project that we believe cannot be completed safely, legally, or to our standards of quality.

3. Bookings & Payment

• A 50% non-refundable advance is required to confirm any booking.
• The remaining balance is due upon delivery of final edited files.
• Payment can be made via bank transfer, UPI, or other agreed methods.
• Invoices are issued within 2 business days of project completion.

4. Cancellation & Rescheduling

• Client cancellation more than 7 days before: Advance is forfeited.
• Client cancellation within 7 days: Full project fee may be charged.
• Weather-related cancellation by us: The session will be rescheduled at no additional cost.
• We will always notify the client as soon as possible in the event of weather or safety-related postponements.

5. Weather & Safety

All flights are subject to safe and legal weather conditions as determined by Ashutosh Banerjee. We follow all DGCA (Directorate General of Civil Aviation) regulations and do not fly in conditions that pose a risk to people, property, or equipment. Safety always takes priority over project timelines.

6. DGCA Compliance & Permissions

Aerials By Ashutosh operates with a valid DGCA Remote Pilot Certificate. For flights requiring special permissions (restricted zones, above regulated altitudes, etc.), it is the client's responsibility to obtain and provide any required location-specific permissions from relevant authorities unless otherwise agreed in writing.

7. Intellectual Property & Usage Rights

• All photographs and video footage remain the intellectual property of Ashutosh Banerjee until full payment is received.
• Upon full payment, the client receives a non-exclusive licence to use the delivered content for the agreed purpose.
• We reserve the right to use delivered content in our portfolio, social media, and marketing materials unless a specific confidentiality agreement is signed.
• Resale or commercial redistribution of delivered content requires prior written permission.

8. Liability

Aerials By Ashutosh carries public liability insurance for our operations. However, we are not liable for:

• Losses arising from force majeure events (extreme weather, government restrictions, etc.)
• Data loss beyond our control after files have been delivered
• Consequential or indirect losses arising from the use of delivered content

Our total liability shall not exceed the total project fee paid by the client.

9. Equipment

We use professional-grade DJI and other certified equipment. In the rare event of equipment failure, we will reschedule the session or offer a proportional refund, as appropriate.

10. Delivery

Edited files will be delivered within the timeframe agreed at booking (typically 5–10 business days for photography; 7–14 business days for video). Rush delivery may be available for an additional fee.

11. Revisions

Each project includes up to two rounds of minor revisions (colour adjustments, trimming, basic editing changes). Major re-edits or reshoots are quoted separately.

12. Governing Law

These Terms are governed by the laws of India. Any disputes arising shall be subject to the jurisdiction of the courts of Mumbai, Maharashtra.
